SUNAPEE BOARD OF SELECTMEN
Meeting 6:30PM at the Town Meeting Room
Monday, November 7, 2011


Present: Frederick Gallup Chairman, Charlotte Brown, Suzanne Gottling and Donna Nashawaty, Town Manager.
Also Present: see attached sign-up sheet.

In absence of Chairman Gallup, Selectman Smith opened the meeting at 6:30PM  

Review of Items for Signature
Motion to approve the following CZC’S: Map 232 Lot 10, 209 Route, 103 Joylon Johnson. Map 148 Lot 41, 55 Chandler Drive, Ross Stinson (also After the Fact Application). Map 128 Lot 45, 42 Garnet Street, Timothy & Judith Zappala. Map 211 Lot 10, 1103 Route 11, ATT Mobility, KJK Wireless. Map 239 Lot 11, 61 Messer Road, Mary Grant & Heidi Hannigan by Selectman Brown, seconded by Selectman Gottling. All in Favor.

Motion to approve the following Sign Permit: Map 133 Lot 34/42, Dock in Harbor, LSPA by Selectman Brown, seconded by Selectman Gottling. All in Favor.
Motion to approve the following Land Disturbance Bond: Map 122 Lot 16, 242 Garnet Hill, Camp David (Barbara Calhoun) by Selectman Gottling, seconded by Selectman Brown. All in Favor.

Public Comments
Representative Spec Bowers reported on the public hearing that was held in Newport on re-districting.

Selectmen Action
Chairman Gallup read the UVLSRPC grant application support letter and signed.
•Motion to reappoint Kenneth Meyer to the Budget Advisory Committee by Selectman Brown, seconded by Selectman Gottling. All in Favor. Chairman Gallup read the letter from Laura Jacobi, who resigned from the Budget Advisory Committee.
•Motion to reappoint Van Webb & Tim Fleury to the Conservation Commission by Selectman Brown, seconded by Selectman Gottling. All in Favor.
Chairman Gallup tabled the Building Permit Approval discussion.


Donna Nashawaty reminded the Board that they were to take home the two ordinances that were handed out at the October 24th meeting and think about what criteria the Board would like to see in the ordinance and whether the policy for the ordinance or the permitting process made more sense. Selectman Brown had some notes; time should be 5Pm to 10PM, specify very specific dates, fines; on the second and third offense the fines are ok, but the fireworks should be confiscated and Selectman Brown added after subsequent offenses a $1,000 fine and confiscation of fireworks. Selectman Gottling has received several phone calls in response to the article in the Intertown Record, very supportive of permitting and of limits on time. Selectman Gottling encouraged the callers to write a letter to the Board. Selectman Brown has also received phone calls; one in particular is very disturbed by the fireworks and wants the Board to be as strict as possible. As far as a permit or no permit, Selectman Brown has no definite opinion, but it’s probably more enforceable with a permit. Chairman Gallup stated that if you’re going to be that restrictive on the dates that the permit process is important. Chief Cahill used the following example; if a complaint came that fireworks were being set-off on Sargent Road and a permit was issued to David Cahill for fireworks that evening, who lives on Sargent Road, it gives the Police Department a direction of where to go. Selectman Smith feels if the town is firm on permits that it would not have to restrict the use of fireworks to certain dates because they might be using fireworks to celebrate a wedding, a special birthday or a retirement party. Selectman Smith went on to say that as long as the restrictions of the permit are followed, Selectman Smith doesn’t think the Board has to be so strong on only allowing fireworks on certain dates. Chief Cahill also feels that Chief Ruggles or one of the Fire Engineers should be involved in the permitting process in case setting off fireworks is not favorable because of dry conditions and that permits should be looked at on a case to case basis. Chairman Gallup thought that the Board might be able to limit the number of times a year a location can obtain a fireworks permit. Chief Cahill favors the permit process and thinks the Board could “fine tune” to their requirements. Chairman Gallup feels that there could be more “hands on “control with the permitting process. Donna Nashawaty suggested that Chief Ruggles come to a meeting and give his thoughts after the Board decides the area restrictions on a permit. Donna Nashawaty stated that she is hearing that the Board wants to go with a permit. After much discussion,
Donna Nashawaty will make the changes that the Board suggested to the ordinance and bring back for their review.    

Chairman’s Report
•Chairman Gallup thought the budget session on Friday, November 4th went well. The nuts and bolts of the budget look to be very good. Basically, the issues will be with personnel and compensation; 53 weeks of pay and the NH retirement system, etc. Chairman Gallup’s thoughts are that a fair amount of the employees are at the top of their step, so the Board might want to look at possibly freezing the pay tables for this year and look at a 2% COLA, making sure it is not consumed by the increase in the health insurance. Selectman Brown agreed that there needs to be cutbacks and that the line items of the budget should be reviewed to see where some realistic cuts could be made.  





•Selectman Gottling asked if a decision had been made regarding the budget public hearing being held on Tuesday, January 10th. Donna Nashawaty stated that an email had been sent out earlier in the day; Tuesday, January 10th will be the primary day, so the Zoning Board meeting scheduled for Thursday, January 12th    will be moved to Tuesday, January 24th to accommodate the Town’s budget public hearing on Thursday, January 12th. The school’s budget public hearing will be on Wednesday, January 11th. Selectman Gottling asked when the deliberative session would be held. Donna Nashawaty stated that that the school will hold their deliberative session on Monday, February 6th and the Town will hold their deliberative session on Tuesday, February 7th. Donna Nashawaty will distribute a calendar with all the meeting dates at the November 21st meeting. Donna Nashawaty said the Board will soon know what the cost of the ambulance service and dispatch will be, so Donna Nashawaty thought that she would take the numbers that Chairman Gallup suggested and “plug” them into the pay tables to see what the figures looked like. Selectman Brown thought the Board could use the $100,000 from Hydro on something else instead of reducing the bond on the Safety Services Building. Donna Nashawaty reminded the Board that the money can only be used for capital improvements. Chairman Gallup likes the idea of reducing the bond, pays the loan off faster and saves on interest. Donna Nashawaty will put budget review on the November 21st agenda and have the major department heads available for additional questions.     

Manager Report
Donna Nashawaty asked that because the Board would be meeting on Thursday, January 12th for the budget public hearing, would the Board like to sign building permits on that night and forgo the regular scheduled meeting on Monday, January 16th, which is the Martin Luther King holiday. Donna Nashawaty went on to say that the next scheduled Board of Selectmen’s meeting would be on January 30th, which would be the meeting that Donna Nashawaty would have the Board sign the forms and then she would post the default budget and warrant articles.  
Donna Nashawaty reported that the Scenic Byway Grant received from the National Byway is in front of the Governor and Executive Council. Donna Nashawaty asked that the Board start thinking about where they might want to put the kiosks in Sunapee.
•Selectman Brown would like to know who to approach for permission to look over the contents in the Harbor House Livery with someone from the historical society. Donna Nashawaty responded that she asked that question to Jo Hill, Harbor House Livery and Eileen Stiles, Sunapee Historical Society when they made the inventory list. Donna Nashawaty stated that it’s being scheduled to clean-up the trash portion, but going thru the contents has already been done between the Harbor House Livery and Sunapee Historical Society.
•Merry Armentrout, Intertown Record asked for the following clarifications:
1) Did Chairman Gallup mean a 2% decrease? Chairman Gallup replied no, a 2% raise.
2) Would the hours that fireworks could be set off be between 5-11PM, because originally it was said the hours would be between 5-10PM, Donna Nashawaty stated that the draft ordinance would probably say between 5-11PM and then the Board would work from there. Donna Nashawaty stated that the ordinance is still in draft form.
3) Would you say the Board is in agreement on having a permit? Chairman Gallup stated that in his opinion, the Board is generally in favor of a permit process.
